1. Acceptance of Terms

By accessing or using Fonetree (“the Service”), you agree to be bound by these Terms & Conditions. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 13 years old to use Fonetree. If you are under 18, you represent that you have your parent or guardian's consent. By using the Service, you represent that you meet these requirements.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate information when creating your account
• You may not create multiple accounts for abusive purposes

4. User Content

You retain ownership of content you post on Fonetree. By posting content, you grant Fonetree a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating the Service.

You agree not to post content that:

• Is illegal, harmful, threatening, abusive, defamatory, or obscene
• Infringes on intellectual property rights of others
• Contains malware, spam, or deceptive material
• Violates the privacy of others
• Impersonates another person or entity
• Violates community guidelines set by subtree moderators

5. Voice Calls

Fonetree uses phone calls for voice-based replies. By using this feature, you consent to receiving outbound calls at the phone number you provide. Standard carrier rates may apply. You agree not to use the voice call feature for harassment, spam, or any unlawful purpose.

6. Communities (Subtrees)

Users may create and moderate communities (“subtrees”). Community creators and moderators are responsible for setting and enforcing community guidelines. Fonetree may use AI-powered tools to assist in enforcing these guidelines. Fonetree reserves the right to remove communities or moderators that violate these Terms.

7. Content Moderation

Fonetree employs automated moderation (including AI-based content analysis) and human review to enforce platform rules and community guidelines. We reserve the right to remove content, suspend accounts, or take other actions at our discretion to maintain a safe environment.

8. Intellectual Property

The Fonetree name, logo, and all associated branding are the property of Fonetree. The Service's design, features, and functionality are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Fonetree and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim, or $100, whichever is greater.

11. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. You may delete your account at any time. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, and limitations of liability.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the platform. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.
